TERMS AND CONDITIONS
- Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to NSW residents aged 18 years or over.
- Employees (and their immediate families) of the Promoter, Participating Venues (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- Entries into the promotion open on 16/12/2024 and close at 11:59pm AEDT on 31/01/2025 (“Promotional Period”).
- A “Participating Venue” is any Laundy Group venue in NSW that advertises the promotion and stocks the Eligible Products (defined below) during the Promotional Period.
- To be eligible to enter, individuals must purchase two (2) Jim Beam products (“Eligible Products”) from a Participating Venue during the Promotional Period (“Qualifying Transaction”).
- To enter, individuals must then scan the QR code on the counter card, follow the prompts to the promotion entry page, input the requested details and submit the fully completed entry form during the Promotional Period. If a counter card is not displayed at the Participating Venue after making a Qualifying Transaction, it is the individual’s responsibility to request it from Participating Venue staff.
- Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of the number of Eligible Products purchased in excess of two (2) in the Qualifying Transaction; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) maximum of one (1) entry permitted per person per day.
- Only one (1) prize is permitted per person.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
- Incomplete or indecipherable entries will be deemed invalid.
- If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
- The draw will take place at 3 Amy Close, Wyong NSW 2259 on 06/02/2025 at 1:00pm AEDT in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by phone and email within two (2) business days of the draw. Winners (first initial, last name and postcode) will be published in jimbeampromotions.com.au/oplg-byron on the ‘Winners Tab’ on 11/02/2025.
- The Promoter’s decision is final and no correspondence will be entered into.
- The first valid entry drawn will win a trip to Byron Bay for six (6) adults valued at up to $11,334, which includes:
- Return economy airfares between the winner’s closest capital city and Coolangatta, QLD for the winner and five (5) adult guests;
- Return private airport/accommodation transfers for six (6) people in the destination city;
- Three (3) nights' accommodation in a minimum 4 star property, in Byron Bay (minimum of three (3) twin/double bedrooms);
- Three (3) days’ car hire pick up from Coolangatta airport (subject to either winner or any guest being 21 years or over). If the winner and all guests are under 21 years of age, the car hire prize element will be replaced by a ground travel allowance in the form of private transfers on ground in Byron Bay up to the value of $600. All transfers must be booked through the Promoter and their nominated travel agent;
- Dinner at a Byron Bay beachside restaurant for the winner and their guests as determined by the Promoter in its absolute discretion;
- One (1) x AU$500 activity voucher to be determined in consultation with the winner’s preference (such as a surfing lesson, kayak hire, cooking class, etc - in the event that agreement cannot be reached, the Promoter reserves the right to select an activity voucher in its sole and absolute discretion);
- A Jim Beam merchandise pack (to be shared by the winner and their five guests) including 6 x Jim Beam bucket hats, 6 x Jim Beam tote bags and Jim Beam products worth $223.88 which includes:
- 1 x Jim Beam & Cola (10-pack);
- 1 x Jim Beam & Cola Zero (10-pack);
- 1 x Jim Beam White Double Serve (10-pack);
- 1 x Jim Beam Black Double Serve (10-pack); and
- All winner management including securing liability/publicity release paperwork, all bookings, 24 hr phone support for the winner while travelling.
Additional spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner and their guests must finalise the prize booking within 2 months of the date that they successfully claimed the prize and were verified as the valid winner. Travel must be booked at least 60 days prior to intended travel departure. All travel must be completed within 12 months of the prize draw. The winner and their guests must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in. Prize is a single event holiday and cannot be separated into different holiday vacations. No compensation or alternative travel plans will be arranged should the prize winner and/ or their guests miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and guests. Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion. Travel itinerary will be determined by the Promoter in its absolute discretion. Should the Winner wish to extend their trip, permission must be sought from the Promoter who will decide in its absolute discretion. In the event the Promoter agrees for the Winner to extend, all additional expenses to extend will be at the Winner’s own expense, including any additional cost to extend their travel insurance policy by additional days, to ensure continuity of cover for the full duration of the trip.
- Car hire prize is subject to standard rental conditions. Petrol and insurance are not included. Winner must meet all the rental conditions for car hire as prescribed by the car rental company, for example (including but not limited to) minimum driver age must be 25 years or older and maximum driver age is 85 years of age and the nominated driver must have held a full licence for at least 1 year, etc. If the winner doesn’t meet the criteria (e.g. suspended licence) they must nominate a guest who meets the car rental company’s requirements, and the guest must be the nominated driver on the rental agreement.
- Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
- In the event of war, terrorism, state of emergency, government lockdown, pandemic, or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
- The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.
- If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
- Subject to the unclaimed prize draw clause, if for any reason the winner does not take / redeem the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
- If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Total prize pool value is up to $11,334.
- Prizes, or any unused portion of the prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- A draw for any unclaimed prize may take place on 06/03/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone within two (2) business days of the draw and their names will be published at jimbeampromotions.com.au/oplg-byron on the ‘Winners Tab’ on 10/03/2025.
- Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use / taking of the prize.
- The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
